        Ah yes, the Pat Flynn article of last summer.

        Flynn's pitch in Cyberlaw made a bigger splash on Cypherpunks than
it ever did in court. In the real world, Counselor Flynn was unsuccessful
in his efforts to invalidate the RSA patent in his defense of Cylink, and
unsuccessful in asserting the Stanford patents against RSA. Two for two.

        Patrick Flynn, Esq., was a litigation attorney for Cylink who
apparently spent years prepping for a career-defining challenge to the RSA
PK patent. In the end, however, he couldn't convince even Cylink's
management that he had a plausible case with decent odds of appelate
success.

        Denied a courtroom by Cylink's decision to settle its lawsuit with
RSA and buy a RSAPKC license from RSA, Attorney Flynn finally decided to
publish rather than plea.

        I'm biased as hell on this, and not only because I do a lot of
consulting for SDTI, RSA's corporate parent. Anyone who delves into
Flynn's article should also, however, spend some time in the archives of
the Cyberia-L mailing list.

        On Cyberia-L, the IP law profs gently sliced, diced, and quickly
dismissed Flynn's case on the merits when the article first appeared.
